These general terms and conditions of sale apply between Judicieux, a limited liability company with a capital of €20,000, whose registered office is located at 10, boulevard Gaston Birgé - 49000 Angers, registered in the trade and companies register of ANGERS under the number 901 618 694, (hereinafter “Sensitive”), on the one hand, and the Client on the other hand (hereinafter the “Client”).

1. Definitions

- CGV: refers to these general conditions of sale.

- Customer: designates the company or individual having ordered the Products or Services.

- Order: refers to the order for Products or Services placed by the Customer.

- Recurring Order: refers to an Order as described in Article 4 of the GCS.

- Customer Space: designates the Customer's dedicated space accessible with a specific e-mail and password on judicieux.com.

- Parties: jointly designates the Client and Judicious.

- Products and Services: refers to the products and services of Judicieux.

2. Purpose and general provision

An Order concluded by handwritten signature or validation on the Customer Area constitutes a firm and definitive agreement between the Parties and implies full and unreserved acceptance of these GCS.

3. Provisions relating to the Products

3.1 Availability: The Products are offered within the limits of available stocks. A Product may be defective, in which case Judicieux will inform the Customer as soon as possible in order to offer an alternative.

3.2 Use of the Products: The Customer undertakes to use the Products in accordance with their destination and instructions for use. Judicieux can not be held responsible for the misuse of the Products, in particular a use other than that intended or consumption after the expiry date indicated on the packaging of the Products and beyond which their consumption is likely to present an immediate danger. for consumer health.

4. Shipping and Delivery Terms

4.1 Shipping time: The Products ordered by the Customer are shipped within 5 working days from the confirmation and payment of the Order.

4.2 Delivery problem: Judicieux cannot be held responsible for the impossibility of delivering the Products if the delivery address provided by the Customer is not sufficiently precise or if it is incorrect. If a package is returned or lost for non-complaint or incorrect address provided by the Customer, Judicieux reserves the right to invoice the Customer for the return and shipping costs, i.e. a flat rate of €30 excluding tax per package, as well as the possible cost of lost or damaged Products.

4.3 Verification of the Products: In case of damage or error on the Products, the Customer must inform Judicieux within 24 working hours following the date of delivery by email to atelier.judicieux@gmail.com. Judicieux may, at its discretion, choose between reshipping the missing or damaged Products or refunding the price to the Customer.

4.4 Right of Withdrawal: The Customer has, subject to fulfilling the cumulative conditions referred to in Article L121-16-1, III of the French Consumer Code, a period of 14 days from the date of delivery to return at his expense the Products that do not suit him. For health and safety reasons, only Products returned in perfect condition, unused and properly protected in their original packaging will be taken back so that Judicieux is able to offer them for resale. Subject to the foregoing, Judicieux will reimburse the Customer for the cost of the returned Products.

4.5 Legal guarantees: The Customer has the legal guarantee of conformity (articles L. 217-4 to L. 217-14 of the French Consumer Code) and the legal guarantee against hidden defects (articles 1641 to 1649 of the Civil Code French).

5. Prices and VAT

The VAT in force in Metropolitan France will be applied automatically.

6. Payment

Terms: All purchases made on the site are made by means of a credit card or by means of a Paypal account

7. Protection of personal data

7.1 Use: The personal data requested from the Customer is necessary for the processing of his Orders and will be communicated to the service providers in charge of the delivery of his Orders. They may be used to adapt the Judicieux offer to the Customer's needs.

7.2 Access and Rectification: In accordance with the law “Informatique et Libertés” n°78-17 of January 6, 1978 amended in 2004, the Customer has a right to access, rectify and delete data concerning him. He can object to his data being transmitted to third parties by sending an email to atelier.judicieux@gmail.com.

8. Intellectual Property

The elements belonging to Judicieux, such as the website, trademarks, images, sound and video clips, texts, photos, logos, graphic charters, without this list being exhaustive, are the exclusive property of Judicieux and are protected by copyright, trademarks or patents.

9. Evidence

The computerized registers, kept on the servers of Judicieux or on those of its hosts, will be considered, unless proven otherwise, as proof of communications, Orders and payments made between the Parties without prejudice to the possibility for the Customer to report the evidence to the contrary by any legally recognized means.

10. Liability

Judicieux cannot be held responsible for the non-performance of its obligations due to a fortuitous event and/or force majeure or for causes beyond its control. Unless otherwise required by law, Judicieux's liability is limited to the price of the Products or Services sold. Judicieux cannot be held liable for direct, in particular immaterial or indirect, damage that could result from inappropriate use of the Products, particularly when these Products contain usage restrictions.

11. Applicable law

These conditions are subject to French law. This is the case for the rules of substance as well as for the rules of form. In the event of a dispute, the dispute will fall under the exclusive jurisdiction of the Commercial Court of Paris.
